Indian Diplomat Indicted in the U.S., But Set to Leave Country

The Indian diplomat who has been in legal trouble since last month for lying about her domestic worker’s wages on a U.S. visa application was granted diplomatic immunity and reportedly left the country Thursday just as she was indicted for visa fraud, the Associated Press reports.

Devyani Khobragade was charged with making false statements and fraud after she allegedly claimed on visa documents that her housekeeper was making minimum wage, but actually paid her much less.

Khobragade’s Dec. 12 arrest and subsequent strip search before being released on bail has strained U.S.-Indian relations over the past month. India claimed all along that Khobragade—who was the country’s deputy consul in New York and did advisory work at India’s U.N. mission—deserved diplomatic immunity. Khobragade, for her part, publicly criticized the “indignities” of her arrest, including an alleged body cavity search that U.S. officials have denied conducting.

In a letter to the judge, prosecutors said that the chargers against Khobragade will stay pending until she returns to court to face them, with or without immunity status.

I don't know who is guilty? The diplomat might have mistreated her maid or paid below minimum wage. WE DO NOT KNOW. What I do know is that strip searching someone without a trial is a violation of their human rights. Strip searching a consulate officer of a friendly nation is not just a violation of Vienna convention on consular immunity, but it also reeks of either stupidity or recklessness, on the part of US law enforcement.

No country in the world has done this before and got away.

For those not in the know, these incidents involving Indian diplomats (last December 8, an Indian diplomat received a humiliating pat-down at a Mississippi airport) are manufactured to give the United States a black eye in India. Why would patriotic American government officials want that, you ask? Because both political parties were co-opted by Moscow & Allies decades ago, which is why there was no verification of the "collapse" of the USSR, verification being a critical and routine administrative procedure since  the USSR wasn’t occupied by Western military forces, therefore verification is necessary for ensuring the survival of the West. 


Ah, you never thought about "verification", did you, and the media certainly didn't direct your attention to it either. 


Recall President Reagan's favorite phrase, "Trust, but verify". 


Imagine it’s March 1944 and the Allies receive a dispatch from Berlin that Hitler and his inner circle are dead, cremated, and the Nazi government has collapsed. Included in the dispatch are films of crowds in the streets cheering the death of Hitler, attacking SS soldiers and Gestapo and toppling statues of Hitler. What do you think the reaction of the Allies would have been? To pack up the war in Europe, demobilize the armies there? Ah, no. The Allies would have demanded that an occupation of Germany take place, where the Allies (1) could ensure that the Nazi government in Berlin had indeed fallen; and (2) prepare Germany, to the satisfaction of the Western Allies, to enter the pantheon of democratic nations. With that in mind….

This Indian prosecuter from New York is an idiot who can only find Indians who make .01. Percent of the population to investigate !!!!.

US was always in the wrong on this.   Those charges were nothing but cooked up allegations by her maid who wanted to game the system to get asylum and migrate to the US.  That vigilante bleeding heart liberal democrat prosecutor fell line, hook and sinker and took her words as gospel truth without even investigating the case properly!!!!


Nothing will ever happen to her.  She is very much in the US and fully immune from US jurisdiction and laws!!!! 

Her husband and children are all US born citizens.  Once a Republican comes to the White house, all charges will be dropped against her.

@ChikuMisraThe ignorance continues thanks to the media's utter lack of reporting on the details and past history associated with the Indian consulate. This is the 3rd occurrence of a maid working in the Indian consulate and complaining of financial mistreatment and sexual harassment. What is common in all the 3 cases? The maids had worked for several years with theirs bosses in other countries with no problems. Once they happen to come to the US, something magically changes and they file wage discrimination and sexual harassment charges. They conveniently get asylum and visas for their entire family and eventually end up getting green cards. At what point will the US realize that this is nothing but a scheme to game the system to get a green card? Also I suspect the NY AG is calculating the wage based on a 24x7x365 working assumption simply because they are residing in a Indian consulate provided mid-Manhattan well furnished residences which by themselves are worth about $3000/mo.


Putting aside the actual accusations, what good faith effort did the AG do in first communicating with the Indian consulate and asking for details/clarification and possibly resolving this issue diplomatically and in a manner befitting an ally? None whatsoever. Arresting a diplomat of any ally simply based on verbal statements of a maid is a level of stupidity bar none or a deliberate attempt to humiliate. The sad part of this is that pretty much all US diplomats and their families in India will lose out of significant special exemptions that they had been enjoying through Indian generosity well above and beyond anything Indian diplomats receive in the US (tax free imports, special no-wait passage in airports, complete immunity from local traffic violations, etc.).


Ultimately the Indian consulate needs to smarten up and protect their diplomats legally by owning the contracts for the maids.
